Section 1 General information

  1. The following terms of use apply to the use of the TU Kaiserslautern Alumni Network TUKAN and the related online community. By registering and creating a user account including a personal profile, the user agrees to these terms of use.
  2. TU Kaiserslautern reserves the right to make changes to the terms of use. In this case, the user has the right of objection of two weeks after notification of the respective change.
  3. In the interest of easier readability and comprehensibility of the texts, gender-specific differentiation has not been taken into account throughout and the generic masculine has been used. In the interest of equal treatment, the corresponding terms apply to all genders. The abbreviated form of language is merely for editorial reasons and does not imply any judgement.

Section 2 Access

  1. The registration in the TU Kaiserslautern Alumni Network TUKAN is reserved exclusively for alumni (graduates, former employees) and students of TU Kaiserslautern. Other persons and institutions may be permitted to use the system if they submit a written application.
  2. The user will be activated by TU Kaiserslautern after registration with the Alumni Network. TU Kaiserslautern reserves the right to decide on registrations at its own discretion. There is no legal claim to membership in the Alumni Network of TU Kaiserslautern.
  3. The user may not give his access to third parties for use. The user is obliged to keep his access data secret and to protect it from access by third parties.
  4. When registering for the first time, the user enters a combination of a current e-mail address and a password, which the user can change at any time. The password is not visible to the administrators in any case and at any time.
  5. Non-members of the Alumni Network cannot see personal data of other members. Only the public posts on the website www.alumni.uni-kl.de are visible to them.

Section 3 Data release

  1. The user allows TU Kaiserslautern to use and store internally all the data provided by the user for the purposes of alumni activities and networking. In doing so, TU Kaiserslautern complies with the laws applicable to the processing of personal data.
  2. The user can determine the data provided in the portal himself. The user also determines which data is visible to other alumni in the portal. Only the user's salutation, first name, last name and department are visible without restriction to all logged-in members of the portal.
  3. TU Kaiserslautern undertakes to treat the data provided by the user in the portal confidentially and not to pass it on to third parties in any way other than specified in the terms of use and the data protection declaration.
  4. The user acknowledges the associated transfer of his personal data required for the use of the respective service in accordance with the privacy statement when using the cloud service licensed and integrated by TU Kaiserslautern on his own responsibility.

Section 4 User obligations

  1. The user commits to using the portal only in accordance with its actual purpose. In particular, it must be ensured that
    a) the personal access data is not made available to any other person,
    b) the portal is only used for private purposes,
    c) without the express consent of the recipient, the user does not use the portal to send messages with advertising content to other users or third parties (spam messages),
    d) the data of other users is not to be copied.
  2. Each user is responsible for the content in his personal user profile as well as for content posted elsewhere. TU Kaiserslautern is not obliged to check the content of the user profiles.
  3. TU Kaiserslautern is entitled to delete illegal content or content that contradicts the objectives of the alumni network from the portal or individual user profiles and to block a user in the event of a breach of the terms of use.
  4. The data contained in the alumni network is confidential and may not be copied or passed on to third parties. During the use of the portal, the user must ensure that no unauthorised third party obtains knowledge of the data.
  5. The user releases the TU Kaiserslautern from any liability for the content of transmitted (website) content and assures that he will not use the pages provided by TU Kaiserslautern to store or distribute obscene, threatening, racist or defamatory material. The user undertakes to ensure not to violate image rights, copyrights, trademark rights, patent rights or other rights of third parties as well as applicable law of the Federal Republic of Germany. In the event of infringements, TU Kaiserslautern reserves the right to block the user's access to the alumni portal and to take civil action against it.

Section 5 Use and costs

  1. The use of the portal is free of charge for members of the alumni network.
  2. The user is aware that, according to the current state of the art, errors in software programmes and in the associated documentation cannot be excluded. Warranty claims in this context are expressly excluded.
  3. There is no guarantee for the availability of the services or their functionality.
  4. The software provided may not be redistributed without prior permission. This also includes modified or supplemented versions based on the software.
  5. The transfer of functions, parts of functions, database queries, text passages, images and similar – whether in whole or in excerpts – to other software, portals or projects is prohibited.

Section 6 Revocation

  1. The consent to the terms of use is voluntary.
  2. You have the right to revoke your consent at any time with effect for the future.
    The user may terminate his membership in the alumni network at any time by deleting his profile or by sending a declaration of revocation to: Technische Universität Kaiserslautern, Stabsstelle Universitätskommunikation, Gottlieb-Daimler-Str. 47, 67663 Kaiserslautern, e-mail: alumni@uni-kl.de. The user's data will then be irrevocably deleted.
  3. TU Kaiserslautern deletes a user profile if there are no longer any contact details (current address or valid e-mail address) available that enable contact with the user.
  4. TU Kaiserslautern deletes a user profile if relatives have notified TU Kaiserslautern of the user's death.

Section 7 Disclaimer

  1. TU Kaiserslautern assumes no liability towards users of the portal for damages or consequential damages of any kind, including damages for losses due to work interruptions, computer failure or malfunction, and other damages or losses of any kind, unless such damages are proven to have been caused intentionally or by gross negligence on the part of TUK.
  2. TU Kaiserslautern assumes no liability in the event of malfunctions on the Internet.
  3. TU Kaiserslautern is not liable for any breaches of confidentiality of e-mails or otherwise transmitted information.
  4. TU Kaiserslautern is not liable for the content of linked websites, unless the content of the linked website does not correspond to the objectives of the Alumni Network and a removal of the link was deliberately or grossly negligently omitted.
  5. The user indemnifies the TU Kaiserslautern from all claims of third parties with regard to the data provided and specifically posted on the portal.
  6. TU Kaiserslautern is not obliged to check the content of the personal profile or the content posted by the user.

Section 8 Final provisions

  1. Should any individual provisions of these terms of use be or become invalid, this shall not affect the remaining provisions. An invalid or unclear provision shall, in the absence of statutory provisions, be replaced in such a way that the intended purpose is achieved.
  2. Exclusively the law of the Federal Republic of Germany applies to the use of the portal. For all disputes arising from these terms of use – unless statutory legal requirements specify otherwise – the place of jurisdiction is Kaiserslautern.
